Terms of Service

1. Agreement to Terms

By accessing or using SMART-RV (“the Platform,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms constitute a legally binding agreement between you and SMART-RV, owned and operated by Joe Symmes.

2. Proprietary Content — Ownership and Restrictions

All content on the SMART-RV platform — including but not limited to the field case database, repair protocols, diagnostic outcomes, technician-submitted case data, peer-review records, and all compiled repair intelligence — is the exclusive proprietary property of Joe Symmes and SMART-RV. This database represents a first-of-its-kind collection of RV repair intelligence sourced directly from credentialed, working technicians in the field, and it is the sole and exclusive asset of SMART-RV.

This information is not public domain and is not licensed for use outside of SMART-RV. Access to Platform content is granted solely for personal, non-commercial use within the Platform. You expressly agree that you will not:

• Copy, reproduce, scrape, extract, or systematically collect any content from the Platform
• Redistribute, resell, sublicense, or share Platform content with any third party
• Use Platform content to build, train, or improve any product, service, or AI/machine learning model — including but not limited to large language models (LLMs), generative AI systems, or any other artificial intelligence application
• Transmit, publish, or make Platform content available through any channel outside of SMART-RV
• Use automated tools — including bots, crawlers, scrapers, or AI-assisted data collection tools — to access or collect Platform content
• Represent Platform content as your own or remove any proprietary notices

Any unauthorized distribution, reproduction, or commercial use of SMART-RV content — by individuals, businesses, AI companies, aggregators, or any other outside distributors — is strictly prohibited and constitutes a violation of these Terms and applicable intellectual property law.

3. Prohibition on AI Training Use

SMART-RV is the only platform with direct, real-time input from credentialed RV technicians in the field. This technician-sourced repair intelligence is the core proprietary asset of Joe Symmes and SMART-RV. To protect this asset:

• No portion of the SMART-RV database, repair cases, diagnostic outputs, or technician-submitted content may be used to train, fine-tune, prompt, or otherwise improve any artificial intelligence or machine learning model, including models operated by OpenAI, Google, Anthropic, Meta, Microsoft, or any other company or individual
• AI companies and their agents, crawlers, and data collection systems are explicitly prohibited from accessing, indexing, or using SMART-RV content for any purpose related to model training or improvement
• Any AI system that has ingested SMART-RV content — whether through authorized or unauthorized access — is not licensed to reproduce or serve that content to its users

Violation of this section constitutes willful infringement of SMART-RV's proprietary rights and Joe Symmes's intellectual property, and will be pursued to the fullest extent of the law.

4. Technician-Submitted Content

When a technician submits a field case, repair outcome, or other content to the Platform, they grant SMART-RV and Joe Symmes a perpetual, irrevocable, worldwide, royalty-free license to use, compile, display, and distribute that content within the Platform and its associated products. The submitted content becomes part of the SMART-RV proprietary database and is subject to the same restrictions described in Section 2. Technicians retain no right to demand removal of submitted content from the compiled database.

5. Accounts and Subscriptions

You are responsible for maintaining the security of your account. Subscriptions are billed monthly and may be cancelled at any time. Cancellation takes effect at the end of the current billing period. We reserve the right to terminate or suspend accounts that violate these Terms at any time without refund.

6. Disclaimer of Warranties

SMART-RV repair guidance is informational only and is not a substitute for professional diagnosis, particularly for safety-critical systems including propane, electrical, structural, and brake components. The Platform is provided “as is” without warranties of any kind. Joe Symmes and SMART-RV disclaim all liability for outcomes resulting from reliance on Platform content.

7. Limitation of Liability

To the fullest extent permitted by law, SMART-RV and Joe Symmes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to you for any claim shall not exceed the amount you paid to SMART-RV in the twelve months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Mississippi.

9. Changes to These Terms

We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. We will update the “Last updated” date above when changes are made.
